Bring a neighbor or two.....we have to really make some noise about this building being too BIG for that location.   And that it DOES NOT comply with the Tulsa Zoning Code.

The Location
Northeast corner of 33rd street and S. Peoria Ave.  (North of Bricktown Brewery)

 
The Proposal
A mixed-use building unlimited in height with retail, restaurant and banking on the first floor.  75, one- and two-bedroom apartments on floors 2-5, with a bar on the 5th floor.

 
The Recommendation
A mixed-use building 65 feet in height with retail, restaurant and banking on the first floor.  53, one- and two-bedroom apartments on floors 2-4, with a bar on the 4th floor.

 
The Opposition
Multiple meetings with neighborhood associations and business associations have taken place where residents and business owners could express their concerns about this project.   Common concerns are Traffic and traffic congestion, Lack of parking and Pedestrian safety.
 
The Future
This project is important because there are other parcels of land located up and down Brookside that carry the same or similar zoning.  This project could set precedence for those future projects which would drastically change the charm, character and fabric of Brookside that we have today.
 

The Latest Update

September 20, 2023

So, a second planning commission meeting was held and we had more people attend and speak out in opposition of the proposal for rezoning.

This was good but made no difference when it came time for their vote.  The proposal passed the planning commission with an 8-0 vote.

The information I presented was the FACT that this proposal does NOT comply with two sections of the Tulsa Zoning Code.

Section 40.050-A Bars:  Simply stated, a bar CANNOT be located within 300 feet of another bar.  This proposal has a bar within 300 feet of THREE other bars in the immediate vicinity on Brookside.

Section 40.280-A Parking Structures:  This states that the ground floor of a parking structure in a mixed use zone must be screened from view of an abutting public sidewalk by a "liner building."

In my opinion, this is the grounds that we have to stand on for this proposal as it pertains to the Tulsa Zoning Code.

A Developer should NOT be able to pick and choose which sections of the zoning code he wants to comply with and choose those which only benefit his project.

WE can defeat this proposal!!   WE need more voices to be heard.

Please plan to attend the meeting October 5th with our city councilor for district 9 and voice your opinion and help strategize for the upcoming City Council meeting and vote on this proposal.

Another Update

August 28, 2023
 
I spoke with Jayme Fowler (City Councilman) and with Nathan Foster (at the planning commission) this morning.
 
Apparently, the Tulsa World did NOT post notice of the public hearing meeting for the August 2nd TMAPC meeting so this has to start the process all over again.
 
The new meeting will be held September 20, at 1pm at the City Council Chamber downtown.    PLEASE plan now to attend.
 
This gives us more time to rally more troops and raise more awareness to this proposed Albatross of a building.

WE can defeat this proposal!!   WE need more voices to be heard.

The Update

As of August 2, 2023, the Tulsa Metropolitan Area Planning Commission unanimously passed a proposal with a 9-0 vote for new zoning that would allow a sizable project to be built at the NE Corner of 33rd and S. Peoria Ave. (where the current Bank of Oklahoma location is)

It appears that the partners on the project are the BOKF Foundation (property owners) and Fishless Desert Development (developers).

The proposed project is to include first floor restaurant, retail and banking space. Floors 2-4 (or 5) will include 53 (or 75) one -and two-bedroom dwelling units (apartments) and a rooftop bar.   The Developer has asked for a 5-story building unlimited in height, while the Planning Commission has recommended a 4-story building with a maximum height of 65 feet.

While the project does include a two-level parking structure with 61 parking spaces on the first level and 82 parking spaces on the second level, the second level parking will be allocated specifically for the dwelling unit tenants with private access to the second level.  The first level parking will be left to accommodate patrons, employees, deliveries and service providers.

There is debate as to whether or not 61 spaces will be “sufficient” for the proposed uses of the first floor.  As the proposal is presented, and based on the Tulsa Zoning Code, the retail, restaurant and bar spaces DO NOT require any additional parking.
The way the code is written, the first 5000 square feet of floor space is exempt from required parking spots.   The proposed floor plan conveniently and strategically has these spaces located and sized so as NOT to require any additional parking spaces by code.   The banking space has a parking requirement of only 9 spaces by code. This will create More Parking Problems for the patrons to the new establishments as well as the existing establishments of Brookside.   Adjacent and surrounding neighborhoods will also see an increase in street parking and traffic congestion.

Due to the increase in traffic and congested streets, Pedestrians will have to be extra cautious when crossing driveways, parking lots and streets.  NO PLANS are currently being entertained from the City of Tulsa to upgrade or update any Pedestrian Crossings or awareness mechanisms at this time.
